THE ROLE OF TECHNICAL REGULATIONS IN THE FORMATION OF EFFECTIVE QUALITY CONTROL MECHANISMS IN UKRAINE
Abstract
The article highlights the role of technical regulations as a key element of the technical regulation system. It describes the impact of technical regulations on the formation of effective quality control mechanisms in Ukraine. The current technical regulation base and its harmonisation with EU documents are analysed, as are the quantitative and sectoral characteristics of technical regulations. The sources of their official publication and the problems of information accessibility are also identified. It is concluded that technical regulations are a vital means of ensuring product quality and safety in Ukraine, promoting harmonisation with international standards and fostering effective control and fair competition. They establish a regulatory framework for the sustainable development and continuous improvement of production processes. A quantitative and sectoral analysis of the regulatory framework was conducted based on an analysis of data from the automated system 'Technical Regulations' and the Verkhovna Rada of Ukraine website, which are identified as the only reliable sources of information on technical regulations. As of July 2025, 132 technical regulations are in force in Ukraine, more than 73% of which are harmonised with European legislation. This indicates significant progress towards integration into the EU market. The vast majority of technical regulations in Ukraine are approved by the Cabinet of Ministers of Ukraine - 71.97% of technical regulations are adopted in the form of Resolutions of the CMU. These data underscore the centralised nature of decision-making in the field of technical regulation and the significant role of the government in shaping these rules. Most of the regulations have been developed for areas related to consumer safety, such as household appliances, energy, health and the environment. However, there is uneven regulation of different sectors of the economy: several important industries, such as mechanical engineering, agriculture and construction, are poorly covered, and 16 product classes (according to NK 004:2009) are not covered by technical regulations at all. It was concluded that improving the technical regulation system further is necessary to increase the effectiveness of quality control, strengthen fair competition, and integrate Ukraine into the EU's single market.
