THE INFLUENCE OF LABOR LEGISLATION ON PERSONNEL ADMINISTRATION AND BUSINESS MANAGEMENT IN THE ORGANIZATION

Abstract

The article is devoted to topical issues of legal regulation of labor relations between the employer and employees in the field of personnel administration and record keeping. The organizational and legal documentary base necessary to ensure the organization of the labor process in accordance with the norms of current legislation has been analyzed and systematized. It has been established that an important part of the personnel administration system of business entities is the office administration, which acts as an intermediary between the labor legislation and the personnel management system. Objectively, personnel administration acts as a mediator between two areas that do not coincide in all respects: between labor legislation and the personnel management system. The regulatory features of personnel documentation recording the stages of employment of employees are considered. A legal description of the employment contract, employment contract, employment book is given; orders on personnel, personal cards and personal affairs. The authority of the personnel service regarding the accounting of the personnel of the enterprise is outlined. It is emphasized that the observance of key procedures guarantees the implementation of the labor resources management policy in accordance with the requirements of legislation and ethical norms, provides a civilized solution to problems and contradictions that arise between subjects of labor relations. In fact, the personnel service is an «organization within an organization», and from the standpoint of legal, moral, socio-psychological aspects, it performs a role that is not provided for by any regulatory document. Employees exercise their right to work by concluding an employment contract for work at an enterprise, institution, organization or with an individual, therefore, an employment contract is the main, basic form of employment relations between an employer and an employee. Peculiarities of personnel administration under martial law are noted, which indicate that during the period of martial law, the norms of labor legislation are not applied in the part of relations regulated by the Law of Ukraine «On the Organization of Labor Relations under Martial Law».
