IMPLEMENTATION OF THE PRINCIPLES OF GOOD GOVERNANCE AT THE LEVEL OF TERRITORIAL COMMUNITIES OF UKRAINE
Abstract
This study provides a comprehensive and multi-faceted analysis of the theoretical, legal, and practical dimensions of implementing good governance principles at the level of territorial communities in Ukraine, particularly under the unprecedented challenges of martial law. The author examines the alignment of Ukrainian municipal legislation with European standards, including the European Charter of Local Self-Government, the SIGMA principles of public administration, and the updated OECD guidelines for effective decentralization. The research highlights the critical role of digital transformation and e-democracy instruments—such as the national e-DEM platform (encompassing local petitions, public consultations, and participatory budgeting), municipal chat-bots, digital ambassadors, and the unified DREAM ecosystem-as vital mechanisms for securing feedback, reducing the digital divide, and maintaining civic engagement in local decision-making during the war. Furthermore, drawing upon empirical data from the 2024–2025 monitoring reports of the «Transparent Cities» program by Transparency International Ukraine, the article critically evaluates the current state of transparency and anti-corruption integrity across Ukrainian municipalities. It reveals a significant disparity in performance based on city size, with an average municipal transparency score of just 41.6% and widespread deficiencies in local anti-corruption programs, conflict of interest disclosures, and whistleblowing infrastructure. Special attention is paid to the profound impact of the war on local democracy, detailing the expansion of military administrations of settlements (210 created across 13 regions) and the subsequent risks of institutional degradation, the bypassing of collegial municipal procedures, and single-handed budgeting. Additionally, the study outlines the strategic principles for post-war recovery using the 'Build Back Better' approach and highlights the influence of international technical assistance projects, such as the EU's 'U-LEAD with Europe' program, the USAID 'HOVERLA' project, and UNDP initiatives. Finally, the paper formulates scientifically grounded policy recommendations for local self-government bodies, focusing on the implementation of Law of Ukraine No. 3077-IX on municipal service reform, reinforcing anti-corruption compliance, and utilizing spatial planning tools to bolster community resilience in the context of Ukraine's European integration path.
