REGULATION OF THE CRYPTOCURRENCY MARKET: DOMESTIC AND FOREIGN EXPERIENCE
Abstract
The article is devoted to the study of the regulation of the cryptocurrency market in Ukraine and a review of foreign experience on this issue. The relevance of the topic of the article is determined by the consideration of the ways of regulating the cryptocurrency market with the analysis of the adopted specialized legislation in Ukraine, as well as the study of the ways of development of the prospects of the national crypto industry in the conditions of martial law with the available foreign experience. The purpose of the study was to analyze the foreign experience of cryptocurrency market regulation and to reveal the issue of cryptocurrency market regulation in Ukraine. It has been established that the regulation of the domestic cryptocurrency market has a positive perspective in the conditions of martial law, based on the adoption of a special law (the Law of Ukraine "On Virtual Assets") on the regulation of the circulation of virtual assets, however, the main problem is the lack of appropriate changes to the Tax Code of Ukraine. At the same time, there is a draft law with specific changes to the Tax Code of Ukraine and it is awaiting its consideration during the session in the Verkhovna Rada of Ukraine. The foreign experience of regulating the cryptocurrency market of countries such as the USA, Canada, Germany, Japan, France, Portugal, and Poland is systematized. The directions for improving the regulation of the cryptocurrency market in Ukraine were analyzed. The practical value of this study lies in the establishment of directions for improving the regulation of the cryptocurrency market in Ukraine, which were established during the analysis of foreign experience in the regulation of the cryptocurrency market. The foreign experience of cryptocurrency regulation is disclosed. The gaps in the regulation of the domestic cryptocurrency market and certain shortcomings of the foreign experience in the regulation of the cryptocurrency market have been identified. An expert opinion on the further development of regulation of the domestic cryptocurrency market in the conditions of martial law is given.
