REGULATORY FRAMEWORK FOR THE TRANSITION OF DOMESTIC AGRICULTURAL ENTERPRISES TO THE PRINCIPLES OF THE EUROPEAN GREEN DEAL (CASE STUDY OF IMC COMPANY
Abstract
The article provides a comprehensive analysis of the regulatory framework for transitioning Ukrainian agriculture to the European Green Deal principles in the context of EU integration. The relevance is determined by Ukraine's strategic course towards EU membership and the Association Agreement obligations for legislative approximation in environmental protection, climate change, and agriculture. The purpose is to analyze EU and Ukrainian regulatory frameworks defining agricultural sector's green transformation parameters, systematize key regulatory elements at supranational and national levels, and demonstrate practical regulatory impact on IMC agroholding activities on IMC agroholding as a representative example of a large export-oriented agricultural enterprise. The methodological basis includes comparative legal analysis for comparing EU requirements and national legislation, systematization and generalization methods for structuring the regulatory framework, and case study method. Key regulatory elements have been systematized: European Green Deal, Farm to Fork strategy, updated Common Agricultural Policy, carbon border adjustment mechanism (CBAM), and corresponding Ukrainian legislative acts in agrochemical regulation, organic production, and land protection. Significant gaps in national legislation regarding implementation of European environmental and climate standards have been identified, including absence of quantitative targets for pesticides and fertilizers reduction, declarative nature of climate commitments without sectoral specification, and insufficient monitoring mechanisms. Using IMC agroholding as IMC agroholding as an example, mechanisms of adaptation of large agricultural enterprises to new regulatory requirements are demonstrated, identifying main risks (increased compliance costs, capital intensity of environmental investments) and opportunities (access to green financing, strengthening competitive positions in EU markets). The practical significance lies in forming scientifically grounded recommendations for agricultural enterprises on phased green transition implementation and regulatory risk minimization.
