INNOVATIVE CHANGES IN INTERNATIONAL BUSINESS DEVELOPMENT AND EXPORT CONTROL FOR DUAL-USE GOODS (TECHNOLOGIES)

Abstract

The war in Ukraine has significant economic consequences through commodity and financial markets, trade and migration ties, as well as the confidence of investors and consumers, worsens short-term and global prospects, requires innovative changes in the development of entrepreneurship at the international level, strengthening export control over goods (technologies) of double using. The goal is to study innovative changes in the development of entrepreneurship at the international level and measures to comply with international legal norms and practices of export control of dual-use goods (technologies) to prevent their misuse or other security threats. The results of the study show that in times of war or increased security requirements, governments strengthen export control regimes: basic ideas and approaches, relationship with international treaties, initiatives, sanctions and embargoes on dual-use goods (technologies) by expanding the list of controlled goods; introduction of stricter requirements for licensing and verification of export applications; updating its lists of prohibited or restricted actors or countries to include those involved in conflict or those deemed to pose a greater risk of proliferation. It is noted that the war led to the strengthening of law enforcement measures aimed at preventing the diversion of dual-use goods to illegal or military purposes through the regulation of issues of customs clearance of goods, international transfer of goods subject to state export control, carrying out processes of their customs control and registration, inspections, audits such procedures. The need to bring the legislation and regulatory framework of Ukraine into line with the circulation of dual-use technologies according to the standards provided by the relevant European Union Regulation, to apply sanctions for violating such requirements, to impose export embargoes or sanctions on certain countries or regions that will help influence the export of dual-use goods, is emphasized. limiting their availability to certain entities.
