GENESIS OF THE REGULATORY AND LEGAL FRAMEWORK FOR STATE REGULATION OF PUBLIC PROCUREMENT IN UKRAINE
Abstract
The article is devoted to the study of the genesis of the regulatory and legal framework for state regulation of public procurement in Ukraine in the context of transformations in the economic, institutional, and security conditions of state functioning. It is substantiated that the development of the legislative framework for public procurement reflects a gradual transformation of the substance of state regulatory influence, from predominantly administrative and procedural regulation towards digital, risk-oriented, and strategic regulation. The study develops a periodization of the evolution of the regulatory and legal framework for public procurement based on changes in the objectives, instruments, and economic substance of state regulation. The formation of the national regulatory model, the transition to an electronic procurement system, the institutionalization of risk-oriented monitoring and professionalization of procurement activities, the adaptation of regulatory mechanisms to martial law conditions, and the current stage of harmonization of Ukrainian legislation with the acquis of the European Union are examined. It is established that each stage is characterized by a changing balance between procedural requirements, economic efficiency, competition, control, the timeliness of managerial decision-making, and the strategic objectives of public policy. The main trends in the contemporary transformation of the regulatory and legal framework are identified: the expansion of procurement efficiency criteria towards the development of the Value for Money concept; the shift from predominantly ex-post control to preventive risk management; the evolution of digitalization from procedural automation to the development of an integrated information and analytical environment; the increasing importance of the professional capacity of procurement actors; and the growing role of public procurement in implementing the state’s innovation, environmental, social, and security priorities. It is proved that further modernization of the regulatory and legal framework should be based on a transition towards an integrated strategic model of state regulation of public procurement, in which European integration requirements are combined with mechanisms for economic efficiency, risk management, digital governance, and ensuring the long-term resilience of the state.
