FORENSIC COMMODITY EXPERTISE AND PRODUCT LABELLING VERIFICATION: TYPICAL NON-COMPLIANCES WITH STANDARDS AND ASSESSMENT METHODOLOGY
Abstract
The study examines forensic commodity expertise of product labelling as a key instrument for consumer protection and market transparency. Labelling fulfils informational, identification, traceability and legal functions; incomplete or false data distort consumer choice and may conceal falsification. The research focuses on food, cosmetic and textile products, which generate the highest number of compliance disputes. The methodology integrates comparative legal analysis, systematisation of Ukrainian regulations, literature review and expert modelling of verification steps. A unified forensic examination algorithm is developed, comprising regulatory field identification, inspection of all information carriers, checklist verification of mandatory requisites, logical cross-checking with supporting documentation, laboratory verification when composition discrepancies are suspected, and legally grounded conclusion drafting. The results classify typical labelling non-compliances and introduce an assessment matrix for expert practice. Frequent deviations include missing mandatory data, language violations, false composition or origin claims, document-label inconsistencies, improper use of conformity marks, and altered shelf-life indicators. The matrix enables systematic evaluation of completeness, readability, traceability, reliability and safety warnings, distinguishing formal defects correctable by relabelling from material violations that mislead consumers or indicate fraud. The proposed approach ensures reproducible expert conclusions, minimises arbitrary interpretation and supports consistent regulatory decisions. It is applicable in forensic institutions, market surveillance, import control and corporate compliance procedures, thereby strengthening evidentiary standards in judicial proceedings and commercial dispute resolution. The framework aligns with national market surveillance priorities and provides a structured evidentiary basis for resolving commercial disputes.
