ECONOMIC AND LEGAL FOUNDATIONS FOR REGULATING CONTRACTUAL RELATIONS IN PUBLIC–PRIVATE PARTNERSHIP PROJECTS IN CONSTRUCTION
Abstract
The article is devoted to topical issues of economic and legal regulation of contractual relations in public-private partnership projects in the construction sector in the context of post-war recovery of Ukraine. Public-private partnership is analyzed as a complex system of long-term contractual relations in which economic substance and legal form are combined in order to achieve strategic public goals related to infrastructure reconstruction and modernization. The study considers public-private partnership not merely as a mechanism for attracting investment, but as an institutional framework that determines the balance of interests, responsibilities and risks between the public and private partners. The article systematizes approaches to the formation of public-private partnership contracts, including the allocation of risks, definition of contractual obligations and management of the full life cycle of construction objects. Particular attention is paid to the importance of contractual regulation for ensuring project sustainability, economic efficiency and protection of public interests under conditions of limited budgetary resources and increased security risks. The research emphasizes that the effectiveness of public-private partnership projects directly depends on the quality of economic and legal mechanisms embedded in contractual relations. The study examines the regulatory and legal framework governing public-private partnership in Ukraine, taking into account recent legislative changes and the need to harmonize national regulation with international standards and OECD principles. The analysis highlights existing institutional and legal barriers that limit the effective implementation of public-private partnership projects in construction, including insufficient integration of economic and legal instruments throughout the project life cycle. The article substantiates the need to improve contractual regulation as a prerequisite for increasing the efficiency of construction projects, strengthening economic resilience of the sector and supporting sustainable development in the post-war period.
