Abstract

The article is devoted to the study of the role of intellectual property in the functioning and development of the creative sector of the economy in the conditions of dynamic digital transformation, as well as to the identification of mechanisms for improving the tools for protecting and commercializing intellectual property rights. A theoretical analysis of the essence and structure of intellectual property in the creative industries has been carried out. The features of intellectual labor in the creative sector of the economy have been identified. The role of intellectual property in shaping the competitiveness of the creative sector of the economy is analyzed. Mechanisms for the commercialization of intellectual property in the creative sector of the economy are identified. Recommendations have been formulated for further research in the field of intellectual property protection in the creative sector of the economy. Improving the system of intellectual property protection in the creative sector has a significant practical impact on the economic development of the economy. Effective protection of intellectual property rights contributes to increasing the investment attractiveness of creative industries and attracting international partners. The creation of effective mechanisms for the commercialization of intellectual property stimulates the development of entrepreneurial activity in the spheres of culture, art, IT, media, etc. Improving the legislative framework will ensure a balance between creative freedom and the economic interests of creators. Taking into account the impact of AI on the formation of intellectual property rights when developing a legislative framework for the protection and control of intellectual property rights. In an effort to protect intellectual property rights in creative industries, ethical implications should also be taken into account, such as the fair use of technology, issues of cultural appropriation, and accessibility to artistic and creative projects. A balance between the protection of intellectual property and the principles of open access and cultural diversity is important.
