IDENTIFICATION, ORGANIZATIONAL AND LEGAL REGULATION OF ENTREPRENEURIAL ACTIVITY AND CHALLENGES FOR BUSINESS ENTITIES
Abstract
Entrepreneurial activity is diverse and multifaceted, therefore it plays a decisive role in the formation of a new national economy, and the experience of developed countries in matters of entrepreneurship development is intended to become a driving force in the post-war restoration of the Ukrainian economy. Domestic scientists had not previously studied the issues of regulation of entrepreneurial activities during the war, because the field of entrepreneurship is faced with such challenges for the first time in the history of the country. Therefore, the purpose of this study is to generalize the norms of current legislation and assess the directions of organizational and legal regulation of economic activity in the conditions of martial law for business entities. The fundamental approaches to organizing economic activity in Ukraine for micro- enterprises, small and medium-sized businesses, and large enterprises were investigated. The processes of formation (legalization) and reorganization of business entities in Ukraine have been clarified. The decisive role of the state in regulating entrepreneurial activity has been proven, in particular in matters of legal regulation of the taxation sphere, taking into account international experience, etc. An analysis of the conditions for conducting entrepreneurial activities during the war was performed and the multidimensionality of the task of restoring and developing SMEs through close interaction between the state and business entities was proven. The purpose of the study is to perform identification, organizational and legal regulation of entrepreneurial activity and analysis of challenges for business entities. The methodological basis of the study is a systematic approach, the method of comparative law and expert assessment. The scientific novelty lies in the multifaceted approach to considering the issues of regulating entrepreneurial activity in the new transformational conditions of the functioning of business entities. The study proposes practical recommendations for formulating key tasks for supporting SMEs. The results of the study can be used in the process of legal regulation of business activity and state policy in the area of entrepreneurship.
