THE SYSTEM OF FORMATION OF THE CIVIL SERVICE PERSONNEL RESERVE: LEGISLATIVE REGULATION AND PRACTICAL INSTRUMENTS

Abstract

The article highlights the issues of the system of formation of the personnel reserve of the public service of Ukraine, in particular, its legislative regulation and practical instruments, especially in the context of new challenges related to martial law and territorial reintegration. The purpose of the study is to analyse the current state, needs and changes in the system of the personnel reserve, and to consider the practical mechanisms introduced to ensure the effective operation of public authorities in crisis conditions. The relevance of the study is driven by the need for a new personnel policy that takes into account current social challenges, including the provision of highly qualified personnel to the authorities in the de-occupied territories capable of performing recovery and stabilisation tasks. The research methodology is based on a systematic analysis of the legal framework for the civil service personnel reserve, as well as a comparative approach to assessing new legislative initiatives and administrative changes. The methods of legal analysis were also used, which allowed for a deeper study of changes in Ukrainian legislation and their implications for the organisation of the civil service. The study found that the development of the talent pool in Ukraine was initially enshrined in the 1993 legislation, but after the adoption of the new version of the Law of Ukraine ‘On Civil Service’ in 2015, the importance of this institution decreased, as the talent pool instrument was cancelled. An analysis of the 2020 initiatives shows that the return of the talent pool to public administration was planned through the concept of a ‘candidate pool’, but the draft law was not adopted. Subsequently, given the challenges of the war, the reserve system was transformed by launching a pilot project aimed at creating a reserve of personnel to work in the de-occupied territories, which allows veterans, internally displaced persons and other qualified citizens to be involved in the civil service. The project is based on an electronic database administered by the NAUCS and is coordinated in partnership with the Ministry of Reintegration of the Temporarily Occupied Territories and the Higher School of Public Administration. The practical value of the article lies in a detailed analysis of the development of public service personnel reserve instruments, which is important for improving the functioning of the civil service in crisis situations such as war, and contributes to the improvement of personnel policy in the territories that require a special approach to reintegration and staffing.
