CURRENT PROBLEMS OF BUDGET FINANCING AND RESPONSIBILITIES OF PARTICIPANTS IN PUBLIC PROCUREMENT IN UKRAINE

Abstract

Increasing the efficiency of budget financing during public procurement in Ukraine is an important direction for improving the use of public finances in today's conditions. The purpose of the work is to study the current problems of budget financing and the responsibility of participants in public procurement in Ukraine, both budget structures and business structures. The article reveals the reasons, features and forms of manifestation of financial violations during the implementation of public procurement in our country both on the part of customers and on the part of participants; analyzed financial problems that exist in Ukraine when conducting tender purchases; the problems in the activity of the state controlling structures of the country in the field of public procurement are investigated. The article substantiates the directions of reforming the mechanism of financial control over public procurement in Ukraine after the new version of the Law "On Public Procurement" comes into effect in 2020; it is emphasized the need to take into account the experience of the countries of the European Union regarding the control of public procurement; identified financial violations during public procurement already after the entry into force of the new version of the Law of Ukraine "On Public Procurement" and possible ways to overcome them; the effectiveness of the forms of financial responsibility of participants and customers of public procurement in Ukraine and substantiated ways of increasing it have been investigated. The number of complaints submitted to the AMCU regarding the results of tenders, the annual volume of public procurement, and the amount of fines applied for violations in the field of public procurement were analyzed. The positive and negative practices of public procurement in Ukraine are singled out. The article also emphasizes the need to strengthen the role of the public in monitoring public procurement, which should optimize budget expenditures for public procurement, especially at the local level. It is justified that during martial law it is not advisable to reduce the responsibility of participants and customers of public procurements in case they violate the conditions of their conduct.
