INSTITUTIONAL AND ORGANIZATIONAL SUPPORT FOR INTELLECTUAL PROPERTY RIGHTS PROTECTION IN UKRAINE
Abstract
The paper provides comprehensive analysis of the nature, components and peculiarities of the system of institutional regulation and organizational support for intellectual property rights protection in Ukraine. The essence and importance of institutional regulation in ensuring the normal, unhindered implementation and sustainable development of intellectual property relations are determined. Authors proved that in the post-industrial economy development and implementation of the effective system of intellectual property rights protection guarantee complex balancing and harmonization of interests of society and participants of civil turnover of results of intellectual activity. Nature and primary components of the system of institutional ordering of intellectual property relations are investigated including formal institutions comprising international treaties, specific legislation, norms of general law, subordinate acts. Essence and role of informal institutions in regulation of intellectual property relations and structuring interactions of participants of commercial turnover of intellectual property objects are considered. Author proved existence of institutional gap in the system of ordering of intellectual property relations in Ukraine, which is related to predominance of the substituting informal institutions that create for economic actors motivation to infringement of the existing formal regulations in the field of protection of intellectual property rights. Organizational support framework for intellectual property rights protection at national levels is investigated. Research of genesis of Ukrainian system of state regulation of intellectual property relations has been conducted. The results of the study had demonstrated the need for comprehensive restructuring of the Ukrainian system of intellectual property protection in order to stimulate commercial turnover of intellectual property objects and accelerate innovative modernization of national economy. The priorities of development of institutional and organizational support for the protection of intellectual property rights in Ukraine are defined.
